RESOLVE Applauds Return of Compensated Gestational Surrogacy in New York

New York’s Child-Parent Security Act goes into effect February 15.

(February 8, 2021, McLean, VA) RESOLVE: The National Infertility Association celebrates a milestone for New York residents trying to build their families. After passage of the Child-Parent Security Act (S.17 / A.6959) in April 2020, New York will allow residents to enter into compensated gestational surrogacy contracts beginning February 15, 2021.

“RESOLVE applauds Assemblywoman Amy Paulin and Senator Brad Hoylman for their leadership in ensuring family building options are available to all New York residents who need them,” said Barbara Collura, President/CEO, RESOLVE: The National Infertility Association. “New York residents now have the same access to surrogacy arrangements that residents in the majority of other states do. We are so glad that infertile and same-sex couples are no longer forced to leave New York to have a child by a gestational carrier and be able to compensate her.”

The vast majority of surrogacy arrangements are through gestational carriers, where the woman carrying the pregnancy has no genetic link to the child. Gestational carrier pregnancies result from in vitro fertilization (IVF). The Child-Parent Security Act lifted New York’s 28-year ban on surrogacy and legalizes gestational carrier arrangements, where a woman can receive compensation for her time and expenses while she carries the pregnancy.

RESOLVE has been at the forefront of advocacy efforts to lift New York’s ban on surrogacy and has been an active member of the Protecting Modern Families Coalition. RESOLVE’s network of advocates wrote letters to their state legislators, provided key testimony, participated in multiple Advocacy Day’s in Albany, and kept the issue front and center until New York’s Child-Parent Security Act was passed.
