“An Act to Amend Titles 10 and 24 of the Delaware Code Relating to Fertility Treatment;” effective 9/24/24

“ ‘Fertility treatment’ means any test, procedure, medication, surgery, or service to address or enhance an individual’s ability to reproduce or get pregnant, including:

1. In vitro fertilization.

2. Intrauterine insemination.

3. Ovulation induction.

4. Embryo biopsy.

4. Cryopreservation and thawing of eggs, sperm, and embryos.

6. Cryopreservation of testicular or ovarian tissue.

7. Storage or disposal of oocytes, sperm, embryos, or tissue.”

“Reproductive health services” includes all of the following:

a. “Abortion” as defined in § 1782 of this title.

b. “Termination of pregnancy” as authorized in § 1790 of this title.

c. Emergency contraception that is approved by the Federal Drug Administration and available overthe-counter, with a prescription, or dispensed consistent with the requirements of Chapter 25 of this title.

d. Services relating to pregnancy or the termination of pregnancy including medical, surgical, counseling, or referral services.

e. Fertility treatment.”

“A law of another state that authorizes a person to bring a civil action against a person that does any of the following is contrary to the public policy of this State:

(1) Terminates or seeks to terminate a pregnancy.

(2) Performs or induces the termination of pregnancy.

(3) Knowingly engages in conduct that aids or abets the performance or inducement of the termination of pregnancy.

(4) Attempts or intends to engage in the conduct described in paragraphs (a)(1) through (3) of this section.

(5) Provides fertility treatment as defined by § 1702 of Title 24.

(6) Attempts or intends to engage in conduct described in paragraph (a)(5) of this section.”

"Georgia Act 41" effective 7/1/2025.

"To amend Chapter 1 of Title 31 of the Official Code of Georgia Annotated, relating to general provisions regarding health, so as to provide that nothing in Georgia law prohibits or prevents an individual from obtaining in vitro fertilization in this state; to provide for a definition; to provide for related matters; to provide for legislative findings; to repeal conflicting laws; and for other purposes."

"Chapter 1 of Title 31 of the Official Code of Georgia Annotated, relating to general provisions regarding health, is amended by adding a new Code section to read as follows:  '31-1-26.  

(a) As used in this Code section, the term 'in vitro fertilization' means a type of fertility treatment in which oocytes are removed from a female's ovary and, in an embryology laboratory, fertilized with a male's sperm to form one or more embryos that begin development in such laboratory and are subsequently transferred to a female's uterus or preserved for future use.  

(b) Nothing in this Code shall be construed to prohibit or prevent an individual from obtaining in vitro fertilization in this state.'"

Public Act 102-1117; “Reproductive Health Act;” amended and effective 01/13/2023

"‘Assisted reproduction’ means a method of achieving a pregnancy through the handling of human oocytes, sperm, zygotes, or embryos for the purpose of establishing a pregnancy. "Assisted reproduction" includes, but is not limited to, methods of artificial insemination, in vitro fertilization, embryo transfer, zygote transfer, embryo biopsy, preimplantation genetic diagnosis, embryo cryopreservation, oocyte, gamete, zygote, and embryo donation, and gestational surrogacy.”

"‘Reproductive health care’ includes but is not limited to: contraception; sterilization; preconception care; assisted reproduction; maternity care; abortion care; and counseling regarding reproductive health care.”

“The State shall not: (1) deny, restrict, interfere with, or discriminate against an individual's exercise of the fundamental rights set forth in this Act, including individuals under State custody, control, or supervision;”

“Reproductive Health Protection Act;” effective 06/01/2023

“A judge may not order a person within the state to give testimony or a statement, or produce documents, electronically stored information, or other tangible things under this subsection, in a case where prosecution is pending, or where a grand jury investigation has commenced or is about to commence, for a violation of a criminal law of another state involving the provision of, receipt of, or assistance with legally protected health care in the state, unless the acts forming the basis of the prosecution or investigation would constitute a crime in this state.”

“‘Legally protected health care’ means all reproductive health services, medications, and supplies related to the direct provision or support of the provision of care related to pregnancy, contraception, assisted reproduction, and abortion that is lawful in the state.”

"Protect Reproductive Options Act;" effective 02/01/2023

“Reproductive health care includes, but is not limited to, contraception; sterilization; preconception care; maternity care; abortion care; family planning and fertility services; and counseling regarding reproductive health care.”

“Every individual has a fundamental right to make autonomous decisions about the individual's own reproductive health, including the fundamental right to use or refuse reproductive health care.”

Resolution AR122

“An Assembly Resolution condemning Alabama court ruling and federal legislation threatening reproductive assistance services and reaffirming New Jersey citizens’ freedom to access reproductive health care services, including in vitro fertilization;” effective 3/18/2024

“The resolution reaffirms the New Jersey Legislature’s commitment to protecting its citizens’ reproductive freedom and full access to reproductive health care, including IVF.”

"Fertility Treatment and Contraceptive Protection Act" effective on 7/1/2025.

"Notwithstanding another law, an individual has a right to engage in activities associated with fertility treatment and contraception. The laws of this state do not prohibit an activity associated with fertility treatment or contraception. The law of this state clearly and unambiguously acknowledges the right of an individual to perform, and the right of an individual to receive or use, fertility treatment and contraceptives in this state." 

"'Fertility treatment' includes: (A) The preservation of human oocytes, sperm, or embryos for later reproductive use; (B) Artificial insemination, including intravaginal insemination, intracervical insemination, and intrauterine insemination; (C) Assisted reproductive technology, including in vitro fertilization and other treatments or procedures in which reproductive genetic material, such as oocytes, sperm, fertilized eggs, and embryos, are handled (D) Genetic testing of embryos; (E) Medication prescribed or obtained over-the-counter, as indicated for fertility; (F) Gamete donation; and (G) Other information, referrals, treatments, procedures, medications, laboratory testing, technologies, or services relating to fertility."
